This is already contractual and it is already enforceable. The Hartford's panel counsel guidelines, revised 20 April 2026, condition acceptance of any assignment on the firm's agreement to the AI terms, and that agreement survives the end of the relationship. The terms require the firm to keep records that allow AI usage to be reconstructed, to name the specific tool in the time entry itself, to permit an audit, and to indemnify the client for any breach.
"Maintain records (e.g., inputs, prompts, data and decisions) that allow for the recreation of generative AI usage" and "Permit The Hartford, or its third-party auditor, to audit Panel Counsel's use of generative AI and related billing."
A reconstructable, auditable record is exactly what a receipt is, and it is made at the time rather than assembled when someone asks. It carries fingerprints and declarations, never your client's content, so it can be handed to an auditor without waiving anything.
