What the statute requires, section by section

Directive (EU) 2024/2853 on liability for defective products, repealing Council Directive 85/374/EEC. The definition of "product" expressly covers software, including AI systems. Provisions addressed:

Art. 9: Disclosure of evidence: a court may order the defendant to disclose relevant evidence at its disposal (proportionate; trade-secret protections apply).
Art. 10: Presumptions of defectiveness and causation, including a presumption of defectiveness where the defendant fails to comply with the Art. 9 disclosure obligation (rebuttable).
Art. 7: Defectiveness (assessment factors, incl. the ability to continue to learn and product presentation).
Art. 8: Damage (including destruction or corruption of data not used for professional purposes). Transposition deadline 9 December 2026; applies to products placed on the market or put into service on or after that date.
