What the statute requires, section by section

Regulation (EU) 2023/2854 (Data Act), harmonised rules on fair access to and use of data. Applies from 12 September 2025. Provisions addressed:

Art. 3: Data accessible to the user by design and by default; pre-contract transparency about the data the connected product generates.
Art. 4: User right to access and use readily available product/service data; data-holder duties and trade-secret safeguards.
Art. 5: User right to share data with a third party (the data holder makes the data available on the user's request).
Art. 6: Obligations of third parties receiving data (permitted-use limits).
Art. 11: Technical protection measures and remedies for unlawful access/use. Where a data holder withholds or refuses sharing on trade-secret or security grounds, it notifies the national competent authority (organisational).
