Enforcement is live. On 11 August 2026 CalPrivacy announced its first action brought under both the CCPA and the Delete Act, against LocateSmarter LLC of Iowa, with a fine of $116,490. The order covers failure to register on time, unlawfully requiring partial Social Security numbers before honouring an opt out, and a CCPA data minimisation violation. Two days later, on 13 August 2026, CalPrivacy announced a second action, against Cybba, Inc. of Boston, with a fine of $52,400 for failure to register by the 2025 deadline, together with an order to publish privacy rights metrics, access DROP and process future deletions through DROP.

What the statute requires, section by section

California Delete Act, Senate Bill 362 (2023), amending and adding to California Civil Code §§ 1798.99.80–1798.99.89 (data brokers). It directs the California Privacy Protection Agency to operate the Delete Request and Opt-out Platform (DROP). Provisions this mapper evidences from the per-event signed record:

Civ. Code § 1798.99.86: beginning 1 August 2026, a data broker must access the deletion mechanism (DROP) at least once every 45 days and process all deletion requests, and must direct its service providers and contractors to delete the consumer's personal information. DROP became available to consumers on 1 January 2026. Failure to process a deletion request is subject to a $200 fine for each request for each day of failure. Beginning 1 January 2028, and every three years thereafter, a data broker must undergo an independent third-party compliance audit.
